So, my gfs 'ex' friend or something has some. *cough* pics *cough* of her now, he said in a text that he will post them up. There is a law against that.. doing it with out permission and such and we have the text that says he will. what law is this and what are our options?
You could bring damages against him for emotional distress. Might not carry too much water since evidently she was cool with it at the time. Defamation of character maybe? In any case, it would be damned indecent of him, and I'd kick his ass if I were you. I would talk to a lawyer though, honestly.
SHE was ok with him taking the pics 3 years ago, not him posting it up in a public place .. thats why they cant make porn and just have it up without the person signing a consent form.
I doubt it will ever go to court, if you think it is a big deal find a lawyer and have some papers drafted just in case. I am not a lawyer and know absolutely zero about the correct procedure for this. Its also 2AM, its just about dead time for here Just tell him to make like a tree and leave.
well, we cant have those pictures up.. he STOLE them from her computer. hes harassing her and me, hes blackmailing us. I dunno that sounds like a perfect case to me.. we have all texts /emails saved
Just have someone from the board call him and pretend to be a lawyer. Or you can file for a restraining order. Just do something to show you are going to do your best to get him in trouble over it. Creep. I am in for some WRXvigilante!
+1 ttiuwop  ........totally joking, I hope he's bluffing, if he does, maybe you can report the site to his hosting company and have them take it down???
I don't think anything can seriously be done criminally. You'll be spining your wheels with a lawyer and burning some major cash.
I have one suggestion, we have some photoshop gurus on here; get some old pictures him and put him in a compromising situation with a farm animal or cambodian boy, or you could just give him a really small penis. Sometimes its best to fight fire with fire, or pedaphilia.
In today's internet age it is virtually impossible to block him from posting said pics online. Unfortunately making a bad decision in the past can come back to haunt you. She is going to have to live with the consequences of her actions. End of story. Sorry!
Why is he threatening this action---what provoked him? Either way I like the idea of photoshopping said ex with a farm animal.
I pose the same question, and I seriously like that idea. Beastiality ftw!!! And however this turns out, fuck this guy. He sounds like a real douchenozzle. And I think douchenozzle should be made the official insult of WRXAtl. Just a thought. /threadjack.
shes dating me now.. thats what provoked.. so she had a talk with her family lawyer.. hes going to the police to see if theres anything that can be done
So draft up some legal work if its a problem... Or just do nothing about it, they're photos. If you really wanted to do something about it, let's just assume he posted said photos, you would need to have the proper paperwork drafted and you would need to contact the server host company that said photos will be posted on. If you provide them with proper paperwork they will remove said photographs.
thats good to hear. He said its a perfect case for harassment. Texas has strict electronic privacy laws. hopefully this can be taken care of in a swift manner.. i told him to send me the pics if he has them.. he hasn't done so. so this could all be a bluff..
Blackmail The crime involving a threat for purposes of compelling a person to do an act against his or her will, or for purposes of taking the person's money or property. The term blackmail originally denoted a payment made by English persons residing along the border of Scotland to influential Scottish chieftains in exchange for protection from thieves and marauders. In blackmail the threat might consist of physical injury to the threatened person or to someone loved by that person, or injury to a person's reputation. In some cases the victim is told that an illegal act he or she had previously committed will be exposed if the victim fails to comply with the demand. Although blackmail is generally synonymous with extortion, some states distinguish the offenses by requiring that the former be in writing. Blackmail is punishable by a fine, imprisonment, or both.
Aww, it would have been amazing had he been dumb enough to post nude pics of an underage girl online. Jail time...:rofl::rofl::rofl::rofl::rofl:
Sure thing man. I hope you get it resolved. Can't have assholes like that fuckin with you and your lady! P.S. Does he drive a neon?
Yeah, theres really nothing that can be done about him stealing the photos from the computer, unless he unlawfully entered the residence. But on the other hand, if she LET him take the pictures, and LET him in the house, you can't really do much there. But as far as posting them, not much can be done to 'stop' him, but if he does it, its a perfect case for defamation of character. I'm pretty sure though if you get a lawyer to just write a letter to him explaining the consequences of his actions if he completes them, he will back down. Don't hire a lawyer to the case unless he posts them, just find one to write a letter and sign it.
im expecting a call anytime now from our family lawyer ... almost excited! also, Greg how would we know if he DOES post them. im trying to get him to send them to me.. to check if he really has them or not.. but if he post them on like youporn or something.. wed never know
Well, from his stand point, if he did post them, he would make sure that you knew about it. That is the whole point, right? Blackmail. He wouldn't really gain anything from posting them without your knowledge, that would basically defeat his whole purpose. To him, its not so much the fact of posting those pictures on the internet, as it is getting back at you.
