yea it was me and another car...two lane road..we both got pulled over..so he was like this is the nicest thing I've ever done..I'm going to give you a ticket for speeding and wrote the code, instead of racing and the code....In the written area it says "racing ga tag# etc" (the other guy that was pulled over).. When he came up to my car he's like "looks like you lost that race" and I told him I wasn't denying that.. I didn't want to be a smart ass and say I only lost cuz I slowed down..ha So we'll see..thanks for everyones input
FkUiHdCncr, here are some question that you need to research, where you in a speed reduction zone? that you know of? and was the officer operating the speed detection device visable for a distance of 300 ft inside the city limit or 500ft outside the consolodated city county limit?or was this on a section of road that had a grade in excess of 7 percent? just more laws that officers break every day I see more officers breaking the not visable for a distance of 300 feet law, And did you know that workers have to be present in a work zone for the "workzone" law to be in affect? just more food for thought. Neat case law that shows how difficult Radar Is to prove in a speeding case which is why it is inaddmissable in court http://www.lawskills.com/case/ga/id/31966/
It's sounding like you're fubar'd no matter how you look at it. If I were you, I would ignore all this shit about 'how the cop was wrong' and how 'he broke blah blah blah gradient / too close / whatever law'. If you go in there defending yourself I get the feeling the judge is going to throw the book at you. Honestly, the only way I see you getting out of this is with a good lawyer, and that's not going to be cheap. I guess the question is, how much is your license worth? Best of luck, dude, but if it were me, I'd be going in tail tucked ready to give sexual favors to whoever the judge is...maybe I'd offer him my sister or something
I believe someone on here tried fighting a ticket by using the gradient argument. He went in with a topography map, and showed that he was on a hill with a greater incline than what the law allows. I believe the outcome was that they didn't care, he would need to have the map creator testify in court that the map is accurate. I think 07Ltd#767 has it right, just accept that you got busted. Don't try to fight the ticket, admit to it honestly and openly, and maybe the judge will give you credit for being honest about it, and help you out a bit. If you fight it, and can't win, the judge will throw the book at you, and you will be in much worse shape.
that is my plan..i messed up..i know I did...hopefully he won't be too harsh like the officer was who could have written me a racing ticket, or even worse taken me to jail. I do appreciate everyones input and yes I am ashamed of what I did, not getting caught, but the fact that this inexcusable act even happened
Hey...save that for when you're in the courtroom - no one's judging you here. All amigos. Don't let the man get you down
Once again you bring up what could otherwise be useful information and twist it around to mean what you want it to mean. You're insistent that radar is inadmissible in court and then try to back that up with outdated case law. In the early '90's there was very little regulation of radar units, nor was there much in the way of standardized training for officers in its operation. NHTSA provided these standards starting in about 1995 - your case law was generated in 1993. If you actually read the case you'll see that there was much more going on than just an innate flaw with radar as a speed detection device as you seem to suggest. My apologies to the OP for going so off topic, but it really bugs me when people when people spread misinformation like this...
Nothing to apologize for Bluelinescooby. You are providing us accurate information which we need. Thank you for clarifying for us.
well...$280 later....ticket wasn't lowered... Atleast he didn't go into the remarks about "racing etc.."...mph wasn't reduced or anything...just glad its done and over w/! Anywone know how many points this will be on my license? Thanks for the supports folks!
depends on how fast you were going over posted...but probably around 3 glad to hear everything worked out alright
Speeding 24 over is 4-6 points, unless there was some sort of plea agreement... they should've told you how many points you got when they handed down your fine...
it was 60 in a 35, all I was told was to have a nice day. Haha. I felt better when I heard the girl behind me talking about her hubby being in jail for two years after hitting her at their trailer park trailer and he was being deported cuz he was an illegal alien... Just remember, it could always me worse!
