The law gives several definitions of what can be considered racing. It can be a contest of speed between two or more vehicles, a timed event over a set distance, a distance event in a set time, or a exhibition of speed or acceleration, among other things. So yes, even if you're not intending on racing anybody and you nail the throttle at a stoplight, you can possibly be cited for racing because that is technically a display of acceleration. If the officer sees two vehicles that he believes are engaged in a street race, that's all he needs to write the ticket. It's then up to the judge to decide whether or not the evidence was there for that ticket to be upheld. If you are speeding next to another vehicle, especially if both vehicles appear to be "sporty," then yeah, I could see how the officer would get the impression that you might've been racing. It's all very circumstantial. Luckily in your case it seems the officer erred on the side of caution, otherwise you would need to go to court and convince the judge that you had no such intentions.

Good to know about the street racing because I occasionally gun it from a stop light and shift at like 5K RPM, but once I get up to the speed limit, I stop. I never knew that could be considered street racing.
i hope so.. my pharmacist i am working with said that asian ppl should watch out when driving through alabama.. she heard stories. AND it doesnt help that i have this HUGE wing on my car.. i should have taken it off... hah.

While on the topic I have to agree with bluelinescuby. When I wrote tickets, I generally gave more to soccer moms hauling are in big suv's than to racer types. It was all about the speed...soccer mom 80 in 45 and sti 60...I am gonna pull the soccer mom. Half the cops I knew did not know a THING about cars...I would point out a particularly cool car going by (like a STI) and they would just give me a blank look or say something like "But it's just a 4 door with a wing!" As for the sticker, kinda meaningless now. I pulled over people even if the had the sticker...meant nothing to me unless there was a badge to back it up. As far as that goes...well if you work at McDonalds you probably get a discount or free food...same goes for other places. As a police officer I was just giving them their employee discount. It's that double edged sword called officer discretion. Now if they were DUI or something that was dangerous to other people it was always a different story. I arrested a couple people in the public safety industry. It sucks, you feel bad, but it happens and you have to do your job. Bottom line, if you don't want to take the risk, don't speed. I too have been followed, pulled for no reason, etc. There are assholes in every industry. Think about the places you have worked. I am sure there were people there that you didn't like. Well same went for me. There were guys I did not like, guys that I did not agree with their practices, etc. People are people no matter what their job title is.
Lol One of my friends has a teg with a type r wing and n1 exhaust. And cops lovess to pull him over, instead of other people that are driving faster. He lost hes liscene, then decided to take off the wing and change to a almost stock exhaust =X
